Servestra Terms of Service

3. SMS Messaging Consent
By signing up for SMS notifications, you agree to the following:
- Opt-in: You provide explicit consent to receive SMS messages from Servestra, which may include promotional offers, service updates, or account alerts. You confirm you are the owner of the phone number provided and are at least 16 years old (or the legal age in your jurisdiction).
- Message Frequency: Messages will be sent approximately 2-5 times per month, though frequency may vary.
- Costs: Message and data rates may apply, as determined by your mobile carrier.
- Opt-out: You may revoke consent at any time by replying “STOP” to any SMS message or using our opt-out page at [insert URL]. After opting out, you will receive a confirmation message and no further SMS messages unless you opt back in.

4. User Responsibilities
You agree to:

- Not send or facilitate prohibited content, including but not limited to spam, fraudulent messages, illegal content, or anything related to cannabis, hate speech, or harassment.
- Not use the Services to harm Servestra, its users, or third parties, including attempting to bypass security measures or reverse-engineer our systems.
5. Account and Security
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Notify Servestra immediately at support@Servestra.com if you suspect unauthorized use of your account.
- Servestra is not liable for any loss or damage arising from your failure to secure your account.
6. Fees and Payment
- Some Services may require payment. Fees will be disclosed at the time of purchase.
- You agree to pay all applicable fees and taxes for your use of the Services.
- Servestra may modify pricing at any time, with notice provided via email or our website.
- All payments are non-refundable unless otherwise stated or required by law.
7. Termination

- Use the Services to send unsolicited messages or violate anti-spam laws (e.g., TCPA, CAN-SPAM).
- Attempt to evade messaging filters or engage in “snowshoeing” (spreading messages across multiple numbers to avoid detection).
- Use purchased, rented, or third-party lists for messaging without verified consent.
- Interfere with or disrupt the Services, including through hacking or denial-of-service attacks.
10. Limitation of Liability
- As-Is Basis: The Services are provided “as is” without warranties of any kind, express or implied, including for merchantability, fitness for a particular purpose, or non-infringement.
- No Liability for Indirect Damages: To the fullest extent permitted by law, Servestra is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.
- Cap on Liability: Servestra’s total liability for any claim related to the Services will not exceed the amount you paid for the Services in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify and hold Servestra, its affiliates, officers, and employees harmless from any claims, losses, or damages (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
12. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
- Disputes: Any disputes arising from these Terms will be resolved through binding arbitration in Tennessee, under the rules of the American Arbitration Association. You waive the right to participate in class actions or class-wide arbitration.
13. Modifications to Terms
Servestra may update these Terms at any time. We will notify you of material changes via email or a notice on our website. Continued use of the Services after changes constitutes acceptance of the updated Terms.
14. Force Majeure
Servestra is not liable for delays or failures in performance due to events beyond our reasonable control, including natural disasters, network failures, or governmental actions.

16. Miscellaneous
